Under Nevada’s super-priority lien statute (NRS 116.3116), a homeowners association lien for unpaid assessments has a portion senior to a first deed of trust, and the Nevada Supreme Court confirmed in SFR Investments Pool 1 v. U.S. Bank (2014) that a properly conducted HOA foreclosure of that portion extinguishes the first mortgage. In the years after the foreclosure crisis, thousands of Clark County homes in master-planned communities like Summerlin, Green Valley, and Southern Highlands were sold at HOA foreclosure sales for a few thousand dollars, with title passing by a Trustee’s Deed Upon Sale and a decade of litigation following over whether the lender’s lien survived. If the home you are buying has an HOA sale in its chain, the validity of that sale, whether the lender tendered the super-priority amount, and the resulting insurability of title are questions that must be examined, not assumed. Nevada’s tax cap is 3% for a primary residence and up to 8% for everything else, and the favorable cap does not automatically follow a new owner. Under the 2005 tax-relief law (Assembly Bill 489), the annual increase in property tax on an owner’s primary residence is capped at 3%, while other property, including rentals, second homes, and investment property, is capped at up to 8%. When a Clark County property sells or changes ownership, the Assessor mails the new owner a Tax Cap Abatement Notice, and the new owner generally must return the claim form establishing the home as a primary residence to receive the 3% cap. Federal Land and the SNPLMA Boundary

Most of Nevada is federal land, and the Las Vegas Valley is ringed by BLM holdings. Under the Southern Nevada Public Land Management Act (1998), the BLM auctions public land within a disposal boundary around the valley, so newer parcels can derive from recent federal patents while growth is constrained by the boundary.
