REFUND POLICY, TERMS OF USE, CONDITIONS AND DISCLAIMERS:

Users of this site [“client(s)”] are subject to all the terms, conditions and disclaimers outlined on this page and throughout this site.  The Client shall not use these services and records for any purpose that (i) infringes any third party’s copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy, or (ii) is defamatory, libelous, unlawfully threatening or unlawfully harassing.

Client understands that information has not been collected for credit purposes and is not intended to be indicative of any consumer’s credit worthiness, credit standing, credit capacity, or other characteristics listed in Section 1681(a) of  the Fair Credit Reporting Act, 15 U.S.C. § 1681 et seq.  The Client shall not use this site or service (i) as a factor in establishing an individual’s eligibility for credit or insurance, (ii) in connection with underwriting individual insurance, (iii) in evaluating an individual for employment purposes, (iv) in connection  with a determination of an individual’s eligibility for a license or other benefit granted by a governmental authority, (v) in any way that would cause the services or information to constitute a “consumer report” under the Fair Credit Reporting Act, 15 U.S.C. § 1681 et seq., or (vi) in any other manner that would cause such use  of the Services to be construed as a consumer report by any pertinent  governmental authority.

 

The Client understands and agrees that information obtained through this site does not constitute a title insurance policy, title commitment and or guaranteed condition of title.  Client further understands and agrees that no information obtained through this site is or shall be construed as legal advice, legal opinions or legal recommendations.  However, upon request, U.S. Title Records can provide client with a referral to a preferred certified real estate attorney in your area..

Please allow approximately 1 to 3 hours for processing and delivery of property reports during hours of operation (7 Days a week: 8:00 am to 11:00 pm, MST). (PLEASE NOTE: Report delivery times are dictated by the complexity of the report/search. The time frames given to research, compile and deliver the services ordered are a general/typical estimate. Depending on the individual, property and/or county, it may take longer than the estimated time frame provided. When client has a particular deadline, PLEASE EMAIL US WITH THE DEADLINE so that we may prioritize the order or let you know that we cannot meet the deadline).

If you do not see your report(s) within the above time frames, PLEASE CHECK YOUR SPAM OR JUNK FOLDERS as your security filter settings may be set higher than standard settings. If you have placed an order after business hours, your report(s) will be processed in the order they were received at the beginning of the following business day. Please allow 1 business day for Nationwide Title Search results and 4-7 business days for the Abstractor Service and Full Chain of Title Report. Allow 24 hours for individual and business profile report processing.

The Client understands and agrees that all information, records and data are pulled from government and/or private databases. Record updates and accuracy are strictly dictated per entity as each entity enters data and updates its digitized records and information. Record databases are updated at predetermined schedules, i.e., weekly, bi-monthly or monthly, depending on the entity. Online transaction and transfer history records include an average 10 – 40 year title history, depending on the county. Records filed or recorded prior to the digitized database in a given county in maintained by the county on microfilm or microfiche and can be obtained through our Abstractor Service (see Property Records page for retrieval).

Client understands and agrees that Abstractor Service and Full Chain of Title pricing and timelines vary depending on the county and/or the property. U.S. Title Records and its representative and/or affiliates, including U.S. Asset Records, shall not be held liable for claims or losses of any kind, for any reason, including alleged losses caused by reliance on the accuracy, reliability or timeliness information obtained through this site.

The Client further understands and agrees that U.S. Title Records, its representatives and/or affiliates including U.S. Asset Records, shall not be liable for any type of economic or noneconomic damages, including special, indirect, consequential, or incidental damages, or damages for lost profits, loss of revenue, or loss of use, arising out of or related to information obtained through this website, or the information contained in it and/or arising out of any occurrence, transaction or communication allegedly made by a third party with respect to information obtained from this site. All attempts are made to ensure the accuracy and completeness of the data provided by U.S. Title Records, U.S. Asset Records or contained in this site.

Client understands and agrees that U.S. Title Records, and any of its representatives and affiliates, including U.S. Asset Records, is specifically released from any and all liability of any kind, for any reason, arising out of the use of this site or information obtained from U.S. Title Records or U.S. Asset Records in any form.

Guarantee – Refund Policy:  U.S. Title Records guarantees that lien information is accurate and will issue a complete refund if material inaccuracies exist and evidence is provided of same.
