Maryland's Ground Rent Trap: You Own the House but Not the Land

In Baltimore City and Baltimore County, thousands of residential properties are subject to ground rent, a Maryland-specific system where the homeowner owns the building but leases the land. The homeowner pays annual rent ($50 to $240/year) to a separate ground rent holder. If the homeowner fails to pay, the ground rent holder can initiate ejectment proceedings and take possession of the property, including the building.

Many buyers purchase Baltimore properties without realizing they are acquiring a leasehold estate (not fee simple). Under Real Property Article Section 8-703, ground rents created after 1884 must be registered with SDAT. Unregistered ground rents were extinguished by law in 2020. New ground rents have been prohibited since 2007. Homeowners can redeem the ground rent under Section 8-110, converting leasehold to fee simple ownership.

Maryland is a judicial foreclosure state under Real Property Article Sections 7-105 through 7-105.14. The lender files a foreclosure action and order to docket (lis pendens). The borrower has the right to mediation. After court approval, the property is sold at public auction. Maryland requires a post-sale ratification (30 to 60 days). For foreclosure auction buyers, a Full Owner Lien Report ($195) is recommended.

Lien Certificate Requirement

Maryland requires a lien certificate from the county finance office before recording any deed transferring ownership.
